NOTICE OF FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION (FWC) INTENDED DECISION

The FWC has granted the listed species incidental take permit described below: The FWC authorizes Sabal Trail Transmission, L.L.C., 400 Colonial Center Parkway, Suite 300, Lake Mary, FL 32746 through permit number # LSIT-16-00002 to take Florida burrowing owl (Athene cunicularia floridana), southeastern American kestrel (Falco sparverius paulus), Florida sandhill crane (Grus candadensis pratensis), short-tailed snake (Lampropeltis extenuata) and Sherman’s fox squirrel (Sciurus niger shermani) incidental to development activities in Florida pursuant to Article IV, Section 9, Florida Constitution; Chapter 68A-27, F.A.C. The authorized locations for said activities are the 4,180 acres of the proposed Sabal Trail Natural Gas Transmission Pipeline and Facilities Project. The term Project includes any phase or part of the Project as well as the whole. Project Area is located along the 232.75 mile Mainline Route from Hamilton County to the Central Florida Hub in Osceola County; the 13.1 mile Hunters Creek Line in Orange County; and the 21.5 mile Citrus County Line in Marion and Citrus Counties, Florida. A person whose substantial interests are or may be affected by FWC’s action may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. A person seeking a hearing on FWC’s action shall file a petition for hearing with the agency within 21 days of receipt of written notice of the decision.
