The following is a list of conditions which cause the structure to be unsafe and in violation of the following Code sections:
CONDITION:
1. The building located on the property is in a general dilapidated condition so severe as to be unfit and unsafe for human occupation, and constitutes a nuisance. It is unsafe and unsanitary and, generally, violates the following code provisions:
Standard Unsafe Building Abatement Code - Section 101.6, Maintenance.
All buildings or structures, both existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguards which are required by the Florida Building Code in a building when erected, altered or repaired, shall be maintained in good working order. The owner, or his designated agent, shall be responsible for the maintenance of buildings and structures.
The structures located on this property have not been maintained in accordance with the above-referenced requirements. They must be maintained or demolished.
2. The building is unsafe also because it meets certain of the criteria shown under the definition for "unsafe building11 given by Section 202 of the Standard Unsafe Building Abatement Code, which states as follows:
Unsafe Building Abatement Code - Section 202, Definitions
Unsafe Building - Any building or structure that has any of the following conditions, such that the life, health, property or safety of its occupants or of the general public are endangered:
1. Any means of egress or portion thereof is not adequate size or is not arranged to provide a safe path of travel in case of fire or panic.
2. Any means or egress or portion thereof such as but not limited to fire doors, closing devices and fire resistive ratings, in disrepair or in a dilapidated or nonworking condition such as that the means of egress could be rendered unsafe in case of fire or panic.
3. The stress in any material, member or portion thereof, due to all improved loads including dead loads exceeds the stresses allowed in the Standard Building Code for new buildings.
4. The building, structure or portion thereof has been damaged by fire, flood, earthquake, wind or other cause to the extent that the structural integrity of the building or structure is less than the minimum requirement established by the Florida Building Code for new buildings.
5. Any exterior appendage or portion of the building or structure is not securely fastened, attached or anchored such that it is capable of resisting wind, seismic, or similar loads as required by the Florida Building Code for new buildings.
6. If for any reason the building, structure or portion thereof is manifestly unsafe or unsanitary for the purpose for which it is being used.
7. The building, structure or portion thereof as a result of decay, deterioration of dilapidation is likely to fully or partially collapse.
8. The building, constructed or requirement of state law.structure or portion thereof maintained in violation of the Standard Codes of a city, has been a specific county, or state law.
9. Any building, structure or portion thereof that is in such a condition as to constitute a public nuisance.
10. Any building, structure or portion thereof that is unsafe, unsanitary or not provided with adequate egress, or which constitutes a fire hazard, or is otherwise dangerous to human life, or, which in relation to existing use, constitutes a hazard to safety or health by reason of inadequate maintenance, dilapidation, obsolescence or abandonment.
The Building Official has found that certain of the conditions listed above, specifically those listed under condition(s) # 1-ALL # 2- # 12 4 56 7 8 9 10 exist(s) on the property. The attached inspection notice s describe(s those conditions.

The Board of Supervisors for the Brighton Lakes Community Development District will hold two public hearings and a regular meeting on Thursday, August 7, 2014 at 6:30 p.m. at the Brighton Lakes Recreation Center, 4250 Brighton Lakes Boulevard, Kissimmee, Florida.

The purpose of the first public hearing, which is a continuance of the public hearing initially held on July 1, 2014, is to receive public comment and objections on the Fiscal Year 2015 Proposed Budget. The first public hearing is being conducted pursuant to Chapter 190, Florida Statutes. The purpose of the second public hearing is to consider the imposition of special assessments to fund the District’s proposed budget for Fiscal Year 2015 upon the lands located within the District, a depiction of which lands is shown below, consider the adoption of an assessment roll, and to provide for the levy, collection, and enforcement of the assessments. The second public hearing is being conducted pursuant to Florida law including Chapters 190 and 197, Florida Statutes. At the conclusion of the public hearings, the Board will, by resolution, adopt a budget and levy assessments as finally approved by the Board. A regular board meeting of the District will also be held where the Board may consider any other business that may properly come before it.

















A copy of the proposed budget, preliminary assessment roll, and the agenda for the hearings and meeting may be obtained at the offices of the District Manager, located at 610 Sycamore Street, Suite 140, Celebration, Florida 34747, Ph: (407) 566-1935, during normal business hours. In accordance with Section 189.418, Florida Statutes, the proposed budget will be posted on the District’s website; www.brightonlakescdd.org/ at least two days before the budget hearing date.

The special assessments are annually recurring assessments and are in addition to previously levied debt assessments. The table below presents the proposed schedule of operation and maintenance assessments. Amounts are preliminary and subject to change at the hearing and in any future year. The amounts are subject to early payment discount as afforded by law.

The tax collector will collect the assessments for platted lots. The decision to collect special assessments by any particular method – e.g., on the tax roll or by direct bill – does not mean that such method will be used to collect special assessments in future years, and the District reserves the right in its sole discretion to select collection methods in any given year, regardless of past practices.

Failure to pay the assessments will cause a tax certificate to be issued against the property which may result in a loss of title. All affected property owners have the right to appear at the public hearings and the right to file written objections with the District within twenty (20) days of publication of this notice.

The public hearings and meeting are open to the public and will be conducted in accordance with the provisions of Florida Law for Community Development Districts. The public hearings and meeting may be continued to a date, time, and place to be specified on the record at the hearings or meeting.

The Board of Supervisors of the Stevens Plantation Community Development District will hold a public hearing on Thursday, August 7, 2014, at 6:00 p.m. in the City Council Chambers at St. Cloud City Hall, 1300 Ninth Street, St. Cloud, Florida.

The purpose of this hearing is to receive public comment and objections on the Fiscal Year 2015 Proposed Final Budget(s), to consider the adoption of an assessment roll, the imposition of special assessments to fund the proposed budget upon the lands located within the District, and to provide for the levy, collection and enforcement of the non ad valorem assessments. The public hearing is being conducted pursuant to Chapters 190 and 197, Florida Statutes.
The District may also fund various facilities through the collection of certain rates, fees and charges, which are identified within the budget(s). A copy of the Proposed Final Budget, preliminary assessment roll and/or the agenda for the hearing may be obtained at the offices of the District Manager, 610 Sycamore Street, Suite 140, Celebration, Florida, 34747 during normal business hours.
In accordance with Section 189.418 Florida Statutes, the Proposed Budget will be posted on the District’s website (http://stevensplantationcdd.org/) at least two days before the Budget Public Hearing date.
The Board will also consider any other business, which may properly come before it. The meeting is open to the public and will be conducted in accordance with the provisions of Florida Law for Community Development Districts. The meeting may be continued to a date, time, and place to be specified on the record at the meeting.
There may be occasions when one or more Supervisors will participate by telephone. At the above location there will be present a speaker telephone so that any interested person can attend the meeting at the above location and be fully informed of the discussions taking place either in person or by telephone communication.
