Final Notice and Public Explanation of a Proposed

Activity in 100-Year Floodplain

 

To: All interested Government Agencies, Groups and Individuals

 

This is to give notice that HUD under Part 50 has conducted an evaluation as required by Executive Orders 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management. The activity is pursuing funding under Multi-Family Housing Program Section 221(d)(4). The subject property, The Proposed Hamilton at Lakeside, is located at the southwest corner of North John Young Parkway and Bermuda Lakes Lane in Kissimmee, Osceola County, Florida and consists of approximately 6.06 acres of undeveloped and wooded land and a drainage ditch on the eastern property boundary. The subject property is identified as tax parcel number: 16-25-29-00U0-0016-0000. The subject property is the proposed location of a two (2) building, 108-unit multi-family apartment complex with an amenity building, maintenance building, and a dog park.

 

According to the Osceola County, Florida and Incorporated Areas Flood Insurance Study dated June 18, 2013 accessed at http://fris.nc.gov/fris_hardfiles/FL/FIS/12097CV000A.pdf, the Base Flood Elevation (BFE) in the area of the subject property is 66.2 feet NAVD88 (67.10 feet NGVD29). Per HUD guidelines, the elevation of occupied space must be at least one (1) foot above the BFE (in this case, 67.2 feet NAVD88). Therefore, in order to prevent impacts to lives and property, the proposed residential structures and amenity building will be developed above the BFE, with the first-floor elevations elevated greater than one (1) foot above the BFE, at 67.66 feet NAVD88 (68.6 feet NGVD29). Only parking, sidewalks, and the proposed maintenance building are located below the BFE. The proposed maintenance building, a non-residential structure, will have a lowest adjacent grade below the BFE at 65.02 feet NAVD 88 (65.96 feet NGVD 29). However, the structure will be floodproofed to at least 1-foot above the BFE in order to comply with HUD Guidelines and protect all insurable property. The maintenance building will have a concrete stem wall that has emergency drains to prevent flooding of this structure.

 

Whenever construction is proposed within a floodplain, the loss of floodplain storage is a potential impact. Floodplains provide storage of water until downstream outfalls recede to a level that will allow the stored water to discharge from the site.

 

HUD has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values:

 

• The subject property is the ideal location for the proposed development. The subject property is of adequate size and allows sufficient density yield to provide the 108 apartments needed to make the project economically feasible. In addition, the property is properly zoned for the proposed development. The proposed development will be located along the Kissimmee Trail walkway, which will be beneficial to the residential component. The subject property is located along a heavily travelled roadway, with an overhead crosswalk, which has average/good exposure with added privacy which is often seen as a benefit to tenants. In addition, the subject property has access to public transportation as the LYNX bus route is immediately adjacent to the property. The area has sufficient supporting commercial/medical/educational developments nearby. Finally, a market study conducted by Colliers International indicated the property is located in an area that is projected to experience significant population growth. As such, demand for housing in Osceola County is expected to increase significantly. Overall, the subject property is considered an ideal location for the proposed development in terms of its location, exposure, and access to public transportation, employment, education, and shopping centers. These characteristics provide supporting uses for the subject property making it desirable for multifamily development.

 

• Alternatives were investigated for the proposed development that included the “no action” alternative. The proposed multi-family development is needed to address the growing demand for housing in this area and would increase the real estate tax base. Kissimmee is a beneficiary of economic growth occurring in a variety of industries. The Orlando metro economy is flourishing. It is outperforming all other Florida metros in terms of job creation. While tourism continues to drive most of the growth, diversification into other sectors is proving beneficial for wage growth, specifically growth in the professional and business services sector. A business-friendly environment combined with ongoing transportation and infrastructure improvements, moderate costs of living and no state income taxes, the Orlando market is expected to continue to expand. All the new jobs and the companies will generate demand for housing and will be the sustaining force for economic growth in the future. In addition, the proposed development is compatible with HUD’s mission to provide safe and attractive housing options for people of all income levels. The no-action alternative would not achieve any of these benefits and thus, would not serve the same purpose.

 

• To comply with the Executive Order, the Sponsor has entered into consultation with registered engineers who have prepared development plans that minimize the effects of the impacts to the floodplains located on the subject property. Off-site fill will be brought to the subject property in order to appropriately grade the site to raise the lowest adjacent grade of proposed subject property residential structures and amenity building to one (1) foot above the base flood elevation in order to mitigate the potential for adverse impacts to lives and property. In addition, the proposed maintenance building will be floodproofed in accordance with FEMA and HUD Guidelines. The subject property will carry flood insurance under the National Flood Insurance Program for any building during the construction period until a LOMR-F is obtained. Finally, all leases/contracts will contain an acknowledgement signed by the tenants indicating that they have been advised that the site is located in a floodplain and that flood insurance is available for their personal property.

 

In order to prevent a loss of available water storage capacity, the proposed development was designed to compensate for the water storage at a “cup for cup” ratio. While portions of the proposed project site will be raised above Base Flood Elevation (BFE), other portions will be lowered to provide for the storage of flood waters within the proposed detention pond, open spaces, and parking lots. Both the pre-development floodplain storage available to the site and the post-development floodplain storage available to the site were calculated during the design and permitting of improvements. In the pre-development conditions, the site provides 8.472 AC-FT of storage volume below the BFE of 67.10 feet NGVD29. Per the proposed design, the post-development site condition provides 8.594 AC-FT of storage volume below the BFE of 67.10 feet NAGVD29. This design ensures that there will be no net loss of water storage at the subject property and, therefore, there will not be any adverse impacts to the adjacent properties. The detention pond will also provide water quality treatment and attenuation for the proposed development prior to discharging into the ditch located to the west of the subject property.

 

HUD has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

 

There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will consider actions taking place in floodplains, it must inform those who may be put at greater or continued risk.
